In this fitness hearing fiasco, a public defender paved the way for a finding of unfitness. This was completely opposite of what the client wanted. Defendant believed and wanted her attorney to argue that she was fit to stand trial. After she got treatment, got medicated, and regained fitness she didn’t thank her counsel. Arizona v. Gant was the landmark decision by the Supreme Court which prevented police officers from searching the contents of a car after the arrest of the driver. The Illinois Supreme Court Decision, People v. Cregan, released on February 21, 2014 has now altered the landscape on searches incident to arrest.
